All traffic and misdemeanor criminal cases are arraigned on the third floor of the Justice Center, 1200 Ontario Street, Cleveland, Ohio.

The traffic arraignment dockets are presided over by magistrates.  If you have a traffic case, your case will either be heard at 8:30 a.m. in Courtroom 3-B or at 1:30 p.m. in Courtroom 3-B or 3-C, depending on the first initial of your last name.  One of the most important aspects of the arraignment is to know your constitutional rights before entering a plea.

If you have been charged with driving under suspension or no driver’s license, you may be eligible to participate in the Traffic Intervention Program (TIP). We have employees in the court who have been trained to assist people in obtaining a valid license if their license has been suspended, forfeited, or if they never had a license.

The misdemeanor arraignments and felony preliminary hearings are presided over by judges. If you have a misdemeanor case, your arraignment will be held in Courtroom 3-C at 8:30 a.m.  If you have a felony preliminary hearing, your case will be heard in Courtroom 3-D at 8:30 a.m.

 Felony Preliminary Hearing

The first appearance a defendant makes in court after arrest or summons is generally known as an arraignment.  In felony matters, this is also known as an initial appearance.  At the initial appearance, the judge informs the defendant and his attorney or public defender of the nature of the charges against him and advises him of his legal rights, including the right to counsel and to bail.  In felony cases, the defendant is not called upon to plead either at the initial appearance or the preliminary hearing.

When only a complaint has been filed against the defendant, he is entitled to a preliminary hearing unless this is waived in writing.  If the defendant waives the preliminary hearing, the judge will order the defendant bound over to the court of common pleas.  If not waived, the judge will schedule the preliminary hearing within a prescribed time period.

At the preliminary hearing, the prosecuting attorney will examine witnesses and introduce exhibits for the state.  The defendant and the judge have full rights of cross-examination and the defendant has the right of inspection of exhibits before they are introduced.  The defendant may move for discharge for failure of proof and may offer evidence on his own behalf.  The defendant has the right to make a statement, not under oath, regarding the charge, for the purpose of explaining the facts in evidence.

Upon conclusion of all the evidence and the statement, if any, of the accused, the court do one of the following three things:  1) find that there is probable cause to believe the crime alleged or another felony has been committed and that the defendant committed it, and bind the defendant over to the court of common pleas; 2) find that there is probable cause that a misdemeanor was committed and that the defendant committed it, and retain the case for trial or order the defendant to appear for trial; or 3) order the accused discharged.  Discharge is not a bar to further prosecution.

Felony initial appearances and preliminary hearings take place at 8:30 am, Monday through Friday, in Courtroom 3D.  The felony initial appearances and preliminary hearings are presided over by a judge of the court.

About the Court

This court is the Municipal Court for the City of Cleveland Heights. Generally, it handles traffic and misdemeanor criminal charges arising in the City of Cleveland Heights as well as civil matters arising in this City whose demand for relief does not exceed $15,000. This court also has a small claims division which handles complaints in which the demand for relief does not exceed $3,000.

Hours of Operation

The court is open Monday through Friday from 8:30 a.m. to 5:00 p.m. It is closed on weekends and legal holidays, Columbus Day, and the day after Thanksgiving.

Criminal Matters

A criminal case is one brought by the State or the City of Cleveland Heights which charges that the defendant violated the law. This court only handles misdemeanors. In other words, criminal cases in which the maximum jail sentence does not exceed one year.

Housing court cases and traffic court cases are both criminal in nature. However, in general, with some exceptions, they are handled on their own separate dockets.

Civil Matters

Generally, a civil case is one in which one entity sues another entity to recover money. Eviction hearings are also included in the court’s civil docket. In this court, one can file claims seeking recovery up to $15,000.

Small Claims Court is also a part of this court’s civil division. It is designed to handle small matters in the simplest manner possible. Recovery in a small claims action is limited to $3,000. Usually, you do not need a lawyer to file a small claims action but you may have one represent you if you wish. This Web Site offers a Guide to Small Claims Court.
